These Terms and Conditions ("Terms") govern your use of the Flot platform, application, and related services provided by Flot — Open Banking Hub SL LIMITED ("Flot", "we", "our", or "us"), a fintech company incorporated in Sierra Leone.
By registering for or using Flot, you agree to be bound by these Terms. If you do not agree, you must not use our services. Please read them carefully.
2. Regulatory Status
Flot operates under applicable fintech regulations in Sierra Leone. Our services are subject to oversight by the Bank of Sierra Leone. Flot is not a deposit-taking institution and does not offer banking services. Funds held in your Flot wallet are not insured deposits.
3. Eligibility
To use Flot, you must:
Be at least 18 years of age.
Be a resident of, or operating within, Sierra Leone or a supported jurisdiction.
Complete the required Know Your Customer (KYC) verification process.
Provide accurate, current, and complete information during registration.
Not be prohibited from using financial services under applicable law.
We reserve the right to refuse service to any individual or entity at our discretion.
4. Services
Flot provides the following services (subject to availability in your region):
Peer-to-peer (P2P) transfers: Send and receive money between Flot users instantly.
Merchant payments: Pay businesses and vendors using your Flot wallet or linked payment methods.
Payment links: Create and share payment links to collect money from anyone.
Flot Wallet: Store funds in your Flot account for use across our platform.
Flot Business: Accept payments via Mobile Money, Visa, Mastercard, and Flot accounts with instant settlement.
We may introduce, modify, or discontinue any service at any time with reasonable notice.
5. User Obligations
As a Flot user, you agree to:
Use the platform only for lawful purposes.
Keep your login credentials and PIN confidential and not share them with anyone.
Notify us immediately if you suspect unauthorised access to your account.
Not use Flot to facilitate fraud, money laundering, terrorism financing, or any other illegal activity.
Not attempt to reverse-engineer, exploit, or disrupt our systems or services.
Maintain accurate account information and update it promptly if it changes.
6. Transactions
All transactions on Flot are subject to the following:
Finality: Once a transaction is confirmed, it cannot be reversed except in cases of verified fraud or system error at our discretion.
Fees: Applicable transaction fees will be disclosed to you before you confirm any transaction. By confirming, you agree to the stated fees.
Limits: Transaction and wallet limits apply per regulatory requirements and may change without notice.
Errors: If you believe a transaction was processed in error, contact us within 30 days at support@flotme.ai.
7. Compliance and Monitoring
Flot is obligated to comply with Anti-Money Laundering (AML) and Counter-Financing of Terrorism (CFT) regulations under Sierra Leone law. As such:
We monitor transactions for suspicious activity.
We may report suspicious transactions to the Financial Intelligence Unit or other authorities as required.
We may request additional documentation or information from you at any time to satisfy our compliance obligations.
Failure to provide requested documentation may result in restriction or suspension of your account.
8. Limitation of Liability & Indemnification
To the maximum extent permitted by law:
Flot shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services.
Our total liability in any matter is limited to the amount of the transaction in dispute.
Flot is not responsible for losses resulting from your failure to secure your account credentials, errors in payment details you provide, or third-party network failures beyond our control.
You agree to indemnify and hold Flot harmless from any claims, damages, or losses arising from your violation of these Terms or applicable law.
9. Suspension and Termination
We may suspend or terminate your account, with or without prior notice, if:
We suspect fraud, money laundering, or other illegal activity.
You violate these Terms or our policies.
You fail to complete or maintain required KYC verification.
We are required to do so by law or regulatory authority.
You may close your account at any time by contacting us at support@flotme.ai. Any remaining balance will be settled in accordance with applicable regulations.
10. Intellectual Property
All content, trademarks, logos, and technology on the Flot platform are the exclusive property of Flot — Open Banking Hub SL LIMITED or its licensors. You may not copy, reproduce, modify, distribute, or create derivative works without our prior written consent. Nothing in these Terms grants you any ownership rights in our platform or services.
11. Data Protection
Your use of Flot is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your data as described therein.
12. Force Majeure
Flot shall not be held liable for any failure or delay in performing our obligations where such failure or delay results from causes beyond our reasonable control, including but not limited to natural disasters, government actions, internet or telecommunications failures, power outages, or civil unrest.
13. Dispute Resolution
In the event of a dispute arising from your use of Flot:
We encourage you to first contact us at support@flotme.ai to resolve the matter informally.
If we are unable to resolve the dispute within 30 days, either party may escalate to the Bank of Sierra Leone consumer complaints process.
Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of Sierra Leone.
14. Amendments
We reserve the right to amend these Terms at any time. We will notify you of material changes via the Flot app or email at least 14 days before the changes take effect. Your continued use of Flot after the effective date of any amendment constitutes your acceptance of the revised Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Sierra Leone. Any disputes shall be subject to the jurisdiction of the competent courts of Sierra Leone.
